Gibraltar Gaming Licence: Who Gets One and Why It Is Hard to Obtain

Gibraltar Gaming Licence: Who Gets One and Why It Is Hard to Obtain

Gibraltar is home to some of the largest names in online gambling, yet it issues far fewer licences than Malta or Curaçao. That is by design: the Gibraltar regulator licenses selectively and expects applicants to bring real substance to the Rock. Here is what that means in practice.

A selective, relationship-based regulator

Gibraltar’s gambling regime is administered by the Gambling Division of the Government of Gibraltar under the Gambling Commissioner. The jurisdiction has traditionally favoured a smaller number of well-capitalised, blue-chip operators over volume, and applications are assessed as much on the strength and track record of the business as on the paperwork. A new applicant without existing scale or a strong management team will usually be steered elsewhere.

Licence types

Gibraltar issues remote B2C operator licences and B2B licences for platform, software and other critical suppliers. The framework has been modernised in recent years to bring it closer to international standards and to strengthen the regulator’s powers, so applicants should expect a contemporary compliance regime rather than a legacy one.

Substance requirements

Licensees are expected to be genuinely managed and controlled from Gibraltar: local offices, senior management on the ground, servers or infrastructure located in the jurisdiction, and a meaningful number of local staff. This is the single biggest difference from lighter jurisdictions and the main reason the licence is chosen by operators who want a European operational base, not just a licence certificate.

Tax and fees

Gaming tax in Gibraltar is levied at a low percentage of gross gaming yield, with fixed annual licence fees for B2C and B2B licensees. Combined with a competitive corporate tax rate, this makes Gibraltar economically attractive for large operators, though the cost of local substance offsets the tax advantage for smaller businesses.

Post-Brexit position

Gibraltar’s licence no longer provides EU-based market access in the way it did before Brexit, and operators targeting EU markets increasingly hold local licences in those markets anyway. Its strengths today are regulatory credibility, tax efficiency and a deep pool of experienced industry talent.

Is Gibraltar right for you?

If you are a well-funded operator planning a European headquarters with real staff, Gibraltar deserves serious consideration. If you need a licence quickly and cheaply to test a product, it is not the place to start. Our corporate and structuring team can help you assess whether a Gibraltar base fits your group structure.
