Esports and Fantasy Sports in Poland: How the Ministry of Finance Classifies Them

Esports and fantasy sports have grown into mainstream entertainment in Poland, and both sit close to the boundary of gambling law. Whether a given format is a competition, a bet or a game of chance determines whether it needs a permit, is reserved for the state or is simply outside the Act. Here is how the Ministry of Finance and the courts approach the question.
Esports tournaments
Competitive gaming tournaments in which players compete against each other for prizes are generally treated as skill competitions outside the Gambling Act, provided the outcome depends on the players’ performance and not on random elements introduced by the organiser. Entry fees and cash prizes do not by themselves make a tournament gambling. Organisers should nonetheless be careful with mechanics such as random seeding for prizes, lucky draws among participants or loot-style rewards, which can introduce an element of chance.
Betting on esports
Accepting bets on the outcome of esports matches is mutual betting within the meaning of the Act and requires a Polish betting permit. Licensed Polish bookmakers offer esports markets under their existing permits, subject to approval of the event types. Offshore esports betting sites, skins-betting platforms and prediction sites that accept Polish players operate without a permit and are subject to enforcement, including domain blocking.
Fantasy sports
Fantasy sports are the hardest case. Free-to-play fantasy leagues with sponsored prizes are generally regarded as competitions. Paid-entry daily fantasy contests with cash prize pools raise the question whether the outcome depends on chance, since it is determined by real-world sporting events the participant does not control. The Ministry of Finance has tended to view such formats cautiously, and operators have structured Polish fantasy products conservatively, typically as free entry or as skill competitions with no purchase requirement. There is no dedicated fantasy sports licence in Poland.
The binding classification decision
Operators uncertain about a format can apply to the Minister of Finance for a decision determining whether a game is a game of chance, a bet or a game on a machine. The decision is binding on the authorities and is the safest way to launch an innovative format in Poland, although applicants should be prepared for a conservative reading.
Related issues
Esports integrity, match-fixing and the participation of minors in betting-adjacent activities are areas of growing regulatory attention. Sponsorship of esports teams by bookmakers is permitted for licensed operators within the advertising rules, and streaming platforms that promote unlicensed betting sites expose their operators and hosts to liability.
